Terms of Business

The following terms and conditions apply between you (the customer) and us/we (Van Circle) for the supply and purchase of vehicles advertised on our website or purchased directly from our premises. Nothing in these Terms and Conditions shall affect your statutory rights. Van Circle is committed to providing the highest standards of customer service. Should you have any issue or complaint, please contact us and we will endeavour to resolve it promptly and fairly.

1. Our Services

Van circle is a subsidiary and trading name of M W Vehicle Contracts Ltd. We are registered with the FCA (FRN 673971) and authorised to provide vehicle finance. We will usually receive a commission from the finance company with whom your business is placed. You are recommended to independently verify your tax position with an accountant or qualified professional, since we are not privy to information, which might materially affect the suitability of any particular financial package. It is your responsibility to ensure that the vehicle you have selected is fit for your purposes and appropriate for your needs.

2. Use of our website

The vehicle specifications and vehicle data displayed on our website are supplied by the relevant motor manufacturers and data supply companies. Whilst we make every effort to ensure the accuracy of the information given, the website should only be used as a guide and purchasing decisions should not be made, nor contracts entered into, without verification of any items of specification which may affect your decision to purchase a product.

3. Pricing

We reserve the right to adjust prices, offers and specifications of goods on our website at any time. Although we will always try to ensure that pricing information on our website is accurate, occasional errors may occur, which could result in goods being advertised at the incorrect price or otherwise misrepresented. We will not be obliged to supply goods at the incorrect price. Should a pricing error be discovered after an order has been taken, we will contact you to ask whether you wish to continue with your order at the amended price or cancel your order. Any deposit held will be refunded. All pricing on our website is in UK Pounds Sterling. Commercial vehicles will normally be advertised excluding VAT and will be subject to VAT unless otherwise stated. If the rate of VAT changes between the point of order and the supply of the vehicle, the purchase cost will be adjusted accordingly.

4. Cherished number plates

If a vehicle is advertised on our website or displayed on our premises with a cherished number plate, the customer is not to assume that such registration number is available with the vehicle, unless stated and confirmed at the time of us accepting an order for the vehicle. If a customer has their own cherished number plate, we will assist the customer with the transfer of the registration.

5. Ordering and payment

a) Acceptance of your order and the formation of a contract between you and Van Circle will commence on payment of a securing deposit or the receipt of a signed order form. By placing an order for a vehicle with Van Circle, you are accepting these terms of business and the contractual obligations. It is therefore important that before you sign the order form you ensure that the contract reflects what has been agreed.

b). You will not be permitted to collect or take away the vehicle until full payment by cleared funds has been received by us. The method for payment must be agreed prior to your collection of the vehicle. Payments by cash will be subject to a limit. If part of the payment is being provided by one of our funders, then finance documents must have been signed and completed before you will be permitted to take the vehicle away.

c). Part exchange: In the event that we agree to accept a used vehicle from you as partial payment, the allowance price will be confirmed to you on our vehicle order form. Should the vehicle be subject to an existing finance agreement, the amount required to discharge the vehicle from the agreement will be deducted from the allowance price. The vehicle must be delivered to us by you and must be in the same condition as at the date it was originally inspected by us, with the exception of fair wear and tear. The part exchange vehicle must be supplied with the V5 registration document, MOT certificate, spare keys and book pack evidence of service history and all other appropriate documentation.

6. Collection of the vehicle

The vehicle is to be collected from our premises on the date that has been agreed. This will normally be confirmed to you at the time of ordering the vehicle. Delivery of the vehicle to you may be offered and provided at an agreed cost to you. Upon your collection of the vehicle, you will be required to sign a vehicle acceptance note. This will confirm the date and time of your collection of the vehicle and will confirm that you have inspected the vehicle and your acceptance of the vehicle and its condition. The vehicle must be taxed prior to you taking the vehicle. You will be responsible for the cost of Road Fund Licence: We will assist you with the online procedures with the DVLA in order for this to be completed.

7. Failure to collect the vehicle

If you fail to collect or pay for the vehicle within 14 days of the scheduled delivery date then we may choose to either, store the vehicle at your cost or, upon giving you 7 days’ notice, choose to treat the contract as wrongfully ended, in which case the clauses detailed in section 8 will apply.

8. Cancellation rights

In the event of your order being cancelled by us, we will refund any deposit paid by you in respect of that order. If you wish to cancel the order prior to delivery, we will require your written confirmation of the request. If we accept your request, we may choose to levy a cancellation charge and withhold any securing deposit payment. The cancellation charge will normally be £300. However, should a vehicle have been modified or have had dealer options fitted at your request, then additional cancellation charges will be requested in order to recover all incurred costs. The above clauses will not apply if you cancel your order by exercising your rights afforded to you under the Consumer Credit Act 2006. The Consumer Protection (Distance Sales) Regulations 2000 or the Financial Services (Distance Marketing) Regulations 2004. A Consumer is an individual buying the goods for the purposes that are wholly or mainly outside any business, trade or profession.

9. Warranty

The vehicle will be supplied with a warranty against mechanical defects. This will be for a minimum period of 6 months from the date of purchase. The terms of the warranty will be confirmed to you within the warranty policy supplied. Extended periods of warranty are available at additional cost. If the vehicle is covered by a manufacturer’s warranty then Van Circle will endeavour to transfer the benefits of this cover to you.

10. Liability

a) Van Circle will not be liable to the customer for any losses that were not caused by any breach on the part of Van Circle, losses that were not in the reasonable contemplation of both parties when the contract was formed. This will not restrict or exclude our liability or limit a customer’s rights in any way that cannot be restricted, excluded or limited by law.

b) Should a complaint by a customer be pursued unreasonably, in all circumstances the customer shall pay us all reasonable costs, including legal costs and fees incurred or in contemplation of court proceedings or threatened by the customer.

11. Use of your data

a) We will treat all your personal information as private and confidential. We will not pass on or give anyone else any personal information except on your instructions or authority, or where we are required to do so by law, or by virtue of our regulatory requirements. We may use information we hold about you to provide information to you about other products and services, which we feel may be appropriate to you. Under the General Data Protection Regulation 2018 you have the right to see personal information about you that we hold in our records. If you have any queries please write to our business address.

b) It is your responsibility to ensure that the information provided to us for any credit application on your behalf is true and accurate. If false or inaccurate information is provided and fraud is detected, details may be passed to a fraud prevention agency: Law enforcement agencies may access and use this information. Should a vehicle order be cancelled prior to delivery, due to the subsequent discovery of inaccurate or false information, we will reserve the right to withhold all or part of any deposit payment, in order to cover costs incurred by our company.

12. Complaints procedure.

a) It is the aim of Van Circle to provide a very high standard of service to every client. It is important to us that all complaints are resolved as quickly as possible and to the complete satisfaction of our clients.
